Welcome! My name is Shane Patrick Irvine and I am both the author, narrator and cartoonist of The Executive Juris Doctor Degree. I consider this collection of law courses to be similar, if not the same, as what one would learn in a traditional law school, seeking a Juris Doctor degree. An executive juris doctor degree or certificate will not qualify students to take the bar exam in any jurisdictions. It is to provide the same generic information offered in law school so that the student is better prepared to deal with in-house legal needs, and know when to bring in a licensed attorney. For example, drawing up a contract and have an attorney check it over rather than having the attorney create the entire instrument.

These courses teach how the Western system of law works, as a whole. It does not go into the ad infinitive argument of breaking down all of the finer points taught with traditional classroom study. For this intended level of study, students will merely need to listen through, and read along, with an open mind. Every time one reviews the curricculum, more information is absorbed and the picture becomes clear. Purchasing the textbook for this course is highly advised. Once students understand the separate disciplines, they will be better prepared to learn how to organize their thought process and, ultimately, learn how to think like a lawyer. While the information provided in law school takes years of study and designed to make students professional experts in each of the required disciplines of law, these classes provide an oversight of the various doctrines of law with the goal of structuring thought processes, learning how to balance utility versus risks [the ability to argue from both sides], and thus, learn to think like a lawyer. 

Curriculum:

  • Contracts law - The study of the formation of contracts and the legal and equitable remedies available;

  • Tort law - The study of intentional wrongs, negligence, and strict liability.

  • Criminal law - The study of crimes against persons and property, the elements of culpability, and the defenses;

  • Property law - The study of moveable property (chattels) and immovable property (real property), the acquisition of property,  and the rights of landlords and tenants; 

  • Civil Procedure - The study of the process of how civil cases are filed, the discovery process, rules of court, and, how such cases advance through the court system; 

  • Criminal Procedure - The study of the process of how criminal cases are filed, the discovery process, rules of court, and, how such cases advance through the court system; 

  • Evidence - The study of the admissibility of evidence and the exceptions to the rule against hearsay;

  • Family law - The study of community property, prenuptial agreements, and child custody issues;

  • Wills - The study of memorial documents that distribute property, methods of distribution in cases of intestate succession,

  • Trusts - The study of contractual instruments to distribute property;

  • Corporations law - The study of organizational business entities, their attributes of personage, survivability, and how they can be utilized to protect assets;

  • Constitutional law - The study of the U.S. Constitution, including the opening clauses, bill of rights, and the reconstruction amendments;

Goals

Students will learn the major principles of the American legal system. The goal is to learn how to think like a lawyer and understand the principles of jurisprudence, as taught in traditional brick-and-mortar law schools. Students will be exposed to all the major doctrines of English common law and American law, to understand how the law interacts with business and society. Knowledge is power, and understanding law is the great equalizer. Those who understand how to form and administer contracts,  structure a corporation for maximum tax benefits, and use the system to their advantage, will have the tools for business success.
